The Opportunity 

TGRC has partnered with a world leading solar energy Asset Manager. Since its founding, the has provided solar asset management, monitoring and technical due diligence services to over 1,300 utility-scale solar power plants with an installed capacity in excess of 2,000MWp.  Clients comprise of leading debt and equity financiers to the solar sector.  

With a new USA office for serving the Americas this hire will be pivotal in driving their goal to be the best asset manager globally. The company are seeking a strong commercial professional who has both breadth and depth of experience to set-up and lead the commercial function in the US, Mexico and on occasion other regions of their operations, and to deliver revenue and contract management as well as regulatory compliance. 

The Role                                                                                                                          

  • This role will be responsible for delivering the commercial functions of a growing number of renewable energy assets in the Americas, working closely with the technical and finance teams as well as externally with our clients. 
  • The successful candidate will ensure compliance with plant and company contracts, as well as compliance with regulatory requirements and permits. Furthermore, the candidate will be responsible for driving revenue enhancements, operating cost reductions and risk management, and facilitating improvements in operating processes and systems. 
  • The Commercial Manager is expected to be able to undertake, for both construction and operational management of solar plants, the responsibilities outlined below with minimum supervision: 
  • Management and resolution of contractual issues related to the operation of plants/SPVs
  • Supporting the company’s in-house onboarding process for commercial and legal matters for new sites, including collaboration with other teams and working closely with clients to obtain required information
  • Ensuring that the company’s in-house Asset Management Platform (“AMP”) is updated at onboarding with contractual obligations and timebound conditions
  • Ensuring that Annual Business Plans are produced for each asset on completion of onboarding
  • Overall contract management (monitoring, tendering, renewal, checking maturities and managing communications including formal notices) including but not limited to:  
    • Power Purchase Agreements (PPA) 
    • Renewable Energy Credits (RECs) 
    • Engineering Procurement and Construction (EPC) contract  
    • Components of Note/Share/Asset Purchase Agreements 
    • Import power
    • Data collector/data aggregator 
    • Operations & maintenance (O&M) contract  
    • Management Services Agreement (MSA) 
    • Property agreements, e.g. Leases and Option agreements
  • Managing SPV insurance renewals and successful completion of any claims
  • Managing SPV warranty claims and extensions
  • Identifying contract optimization opportunities in respect of revenue enhancement and operating cost reductions
  • Managing regulatory interfaces and monitoring of regulatory deadlines/ updates, including assessing and managing any risk impact on plants and holding companies
  • Ensuring compliance with permits, licenses, authorizations, community and biodiversity obligations
  • Supporting company secretary/ corporate governance activities
  • Working alongside internal Technical and Finance teams
  • Interfacing with and reporting to external clients and advisors, as required
  • Business improvement: working to implement new systems to improve overall asset management
  • Business development: working with senior managers to develop new products and services which secure new revenue streams
  • Ability to travel when required

The Person

  • 5 years+ in a similar role in a commercial, finance or legal capacity covering the U.S renewable energy market
  • Working understanding of US regulatory affairs
  • Experience of PPA and REC management and revenue collection 
  • Experience of the PJM energy market (other domestic US markets are an advantage)
  • Operational contract management
  • Demonstrable experience of SPV compliance with US permitting processes
  • Education: Bachelor's or master’s degree
  • Language Skills: excellent English (written & oral). Proficiency in Spanish would be an advantage 
  • IT Skills: Proficiency in the use of Microsoft packages (with key focus on Excel) with the ability to learn quickly other relevant systems
